Privacy Policy

Iron Affinity, Inc. (the “Company”) operates an Internet website with interactive communication features and blog (collectively, the “System”) that collects personal user information and other data, as described herein.  The following privacy policy shall govern our use of the Information.

The Company is committed to safeguarding the privacy on the information you transmit over the Internet to establish an account and through your use of the System. Please read the following policy to understand how your information will be treated.  This policy applies to information submitted to the Company through the Internet only.  This policy may change from time to time, so please check back periodically.  Please keep in mind that some of the services mentioned specifically in this policy may not be available on the System at this time.

The System is not for use by those under age 13.

1. What information does the Company collect from me?

We may collect personal, financial or demographic information (this information includes, but is not limited to, names, addresses, email addresses, dates of birth, phone numbers, bank name, account number and type, length of account, routing numbers, credit card information, and other such information).

Some personal Information is gathered when you register or set up an account.  E-mail addresses are collected when you communicate with us via e-mail.  During registration, the Company asks for specific information about you and/or your company and employees and may collect credit card and banking institution and related data.  Once you register you are no longer anonymous to the Company and are able to take full advantage of certain System offerings.

In addition to registration, the Company may ask you for information at other times, including when you are involved in posting or streaming information to or from the System, when you modify your account, when you post content, or when you report a problem with the System or other products and services.

If you contact the Company we may keep a record of that correspondence.  We may occasionally use e-mail and postal addresses to notify users about updates to the System, new products and services, or products and upcoming events we think you might find interesting. The Company may also occasionally ask users to complete surveys that we use for research purposes.  Wherever the Company collects personal information we make an effort to include a link to this Privacy Policy on that page.

We may also keep track of how many visitors we have, when they visit, and where they come from (their domain name, such as 123.com). Our web server recognizes each visitor’s Internet Protocol (IP) address and the action of each person while on the System. We may collect aggregate information on those pages that persons access or visit. The information we collect may be used to measure traffic within the System, improve the content of the System, ensure compliance with our Terms of Use and applicable law, and for internal review.

We do not intend to collect information from children. The information and services provided to us or our affiliates, sponsors, and advertisers are not intended to be viewed by children (under 18 years old). No information collected from children is knowingly used for any marketing or promotional purposes whatsoever, either inside or outside the Company.

You are prohibited from entering any third-party or customer highly-sensitive personal information into the System. Examples of highly-sensitive information include, but are not limited to, the following: Social security numbers (or in Canada, social insurance numbers) and tax identification numbers; Driver’s license numbers; Financial / card account numbers; Passwords / PINs; Dates of birth; Digital or electronic signatures; Mother’s maiden names; Biometrics (e.g., voiceprints); Medical information; and Health Policy information, including an individual’s health insurance policy number or subscriber identification number.  Accounts and/or data found in violation of this restriction are subject to deactivatation or removal.

2. What about children and COPPA Compliance?

The System is not directed to children under the age of 13, and the Company will not knowingly collect personally identifiable information from children under 13.

We recognize that with proper adult supervision some parents might permit their children to visit the System and use our services.  The Children’s Online Privacy Protection Act (“COPPA”) requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 years of age.

COPPA requires that we obtain the consent of parents and guardians in order for children under 13 years of age to use certain features of our System.  When a child attempts to register and/or provide personal information to the Company, we require a parent or legal guardian to: (a) Register the child by completing a Permission to Participate Form and returning it, by facsimile or postal mail, to us as set forth on the form; (b) Review our Privacy Policy and verify that the child’s parent or guardian knows about and authorizes our information practices related to children protected by COPPA; and (c) Verify via email confirmation a second authorization that the parent or guardian consents to the Company’s Terms of Use, the Forum Agreement, and the Company Privacy Policy.

Without parental permission, we collect only such limited information from children 12 and under necessary to allow us to obtain parental permission. For example, we may ask a child to provide an email address of a parent so we can notify the parent and seek consent. We will not collect more detailed information from a child 12 and younger, such as a postal address or a telephone number, without the consent of a parent or guardian.

Once parental notice and consent has been verified, the information we collect will be treated the same as information collected from any other user. Without verified parental notice and consent, we will not knowingly collect personal information relating to children under 13 years of age, and if we learn that we have inadvertently collected such information, we will promptly delete it.

WE STRONGLY RECOMMEND THAT PARENTS PARTICIPATE IN THEIR CHILDREN’S EXPLORATION OF THE INTERNET AND ANY ONLINE SERVICES AND USE THEIR BROWSER’S PARENTAL CONTROLS TO LIMIT THE AREAS OF THE INTERNET TO WHICH THEIR CHILDREN HAVE ACCESS.

3. Why is information collected?

The Company’s primary goal in collecting information is to establish accounts, provide services to you, bill for account services (if applicable), improve the System, provide technical support, provide you with information on products or services that may be of interest to you, and provide you with the best possible experience on the System.

4. What are cookies and how are they used?

A cookie is a small amount of data that is sent to your Internet browser from a web server and stored on your computer’s hard drive. We may use cookies to enable us to provide customizable and personalized services, to allow faster and easier access to the System and your account information, and to monitor traffic on the System and measure traffic patterns to improve functionality.  Advertising networks that serve ads onto the System, if any, may also use their own cookies.  We also collect IP addresses for system administration and to report aggregate information to our advertisers and business partners, if any.

Our web pages may in the future contain electronic images known as web beacons  (sometimes called clear giffs or web bugs) or other advanced technologies that are useful in the provision of services to you. We may use such devices to verify compliance with our Terms and Service or with any promotions on our websites.

5. How is the collected information protected?

Keeping information secure is an important responsibility. We maintain physical, electronic and procedural safeguards to protect information. Your System account is password-protected. We use encryption technology for financial information, bank account numbers, passwords and registration information. Remember to sign out of your account and close your browser window when you have finished your work. This is to ensure that others cannot access your account by using your computer when you are away from it.

Because of the global nature of the Internet, when you give us information, that information may be sent electronically to servers outside of the country where you originally entered the information. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Except as discussed above or otherwise designated, this site does not use security encryption measures. Therefore, information that you disclose by use of this site (as with any site that is non-secure), by posting data, a message or using e-mail, potentially could be collected and used by others.  This may result in unsolicited messages from third parties or use of such information by third parties for their own purposes, legal or illegal. As a result, while we strive to protect your personal information, the Company cannot ensure or warrant the security of any information you transmit to us or from our services, and you do so at your own risk. Once we receive your transmission, we use commercially reasonable efforts to ensure its security on our systems.

6. How is the collected information used?

Any and all uses of “personally identifiable information” (information that can be used to uniquely identify, contact, or locate a single person or can be used with other sources to uniquely identify a single individual) will comply with applicable U.S. laws. By submitting personally identifiable information you waive any rights you may have under any law of any other country or region.

We strive to keep all personally identifiable information secure and to limit its use to the purposes described here. We do not collect or maintain personally identifiable information for resale purposes. We use personally identifiable information for account management, maintenance and billing purposes only.  We may use your personal information to customize your content and to fulfill your requests. We may also contact you about new offerings and updates to the System.

We may share your personal information with our service providers and strategic partners as necessary to provide a product or service you have requested or to allow our service providers to assist us in making the System and associated services available. All companies with which we do business are contractually obligated to keep the information we provide to them confidential, and to use that information only to provide products or services to you or for us on your behalf.

We may provide non-personalized data and user statistics to prospective partners, advertisers, and other third parties. For example, we may state in marketing materials that X% of our users are from New York or the average monthly page views for all users, or users from a certain geographic area, is X.

We may disclose your personal information to respond to subpoenas, court orders, or legal process, or if we believe that you have violated the Terms of Use Agreement.

7. What about the privacy of Forum content?

The use of any Forum feature on our System is subject to the Forum Agreement [LINK HERE]. Please take note that whatever you post to a public Forum can be read, collected, and used by other users of the Forum. This Privacy Policy does not apply to the personally identifiable information you post to a public Forum, and we are not responsible for the protection or use of information you post to a Forum

8. What are Opt-Out rights?

If you do not wish to receive e-mail or mailed marketing materials from us, or you do not want us to share your e-mail or postal address with other organizations, you may “opt out” by sending an e-mail addressed to IronAffinity@gmail.com.

9. What if the Company undergoes a corporate change?

As we continue to develop our business, we may buy or sell businesses or assets. In such transactions, confidential customer information generally is one of the transferred business assets. In the event of a transaction involving the sale of some or all of The Company’s business, the customer information may be one of the transferred assets.

10. Can this policy be amended?

The Company may amend this policy from time to time. If we make any substantial changes in the way we use your personal information, the changes will appear here and be effective immediately.
